Nigeria’s energy sector is primarily regulated by a combination of legislation and government agencies. The relevant laws can be broken down into two main categories: those governing the petroleum sector and those governing the electricity sector.

Petroleum Sector

The primary law for the Nigerian petroleum sector is the Petroleum Industry Act (PIA) of 2021. This landmark legislation overhauled the oil and gas industry, replacing older laws like the Petroleum Act of 1969.

The PIA’s key objectives include:

  • Introducing a new fiscal framework
Electricity Sector

The main law governing the electricity sector in Nigeria is the Electricity Act of 2023, which repealed the EPSRA of 2005. It provides a comprehensive legal framework for generation, transmission, distribution, and trading of electricity in the country.

Key features of the Act include:

  • Decentralization of power to state governments
  • Promotion of renewable energy through the Renewable Energy Fund (REF)
  • Strengthening the authority of the Nigerian Electricity Regulatory Commission (NERC)
